RVMWeb site licence, services and access agreement

The following text contains the terms and conditions governing the RVMWeb site Licence, services and access agreement. The site and its content are edited and operated by the Bibliothèque de l’Université Laval (the « RVMWeb Use Agreement »). These conditions are applicable to any person wishing to subscribe to it (the « Subscriber ») and to all of its employees with authorized RVMWeb access and which is granted by the Bibliothèque de l'Université Laval (« Licensed Users »).

Before accessing the RVM database, you must read and agree to the terms of the RVMWeb Use Agreement. Some of the services offered may be governed by additional conditions that you must agree to in order to access them. These conditions are in addition to those set out in the conditions of use of RVMWeb. To use the RVM FTP or CDROM versions, please refer to the user licences.

For consortia, the use of RVM or of FTP or CDROM versions must be covered by a specific agreement. Contact RVM staff for more information at rvm@bibl.ulaval.ca.

The RVMWeb Use Agreement grants to the Subscriber a right to access the RVM database, a licence to use the latter and the possibility to receive additional related services, the whole pursuant to the terms and conditions set out in this RVMWeb Use Agreement. The Subscriber is the natural person or legal entity that has taken out the Subscription and whose name appears on the invoice.

The Subscriber has access to the RVMWeb database through an IP address. Its Licensed User employees may create a personal account to access the other services of RVMWeb included in the subscription agreement. The Subscriber may, during the full term hereof, authorize new members of its staff to request a personal account. It may also cancel the authorization for a staff member to create a personal account. Fees may be applicable for additional accounts. Upon approval of a personal account, the Licensed User must change the temporary password provided by RVM and choose a secure password of at least six characters (max. 20).

Services included with the subscription

The RVMWeb Use Agreement includes the following access, licences and services :

  • the search of subject headings in the RVM database;
  • the downloading of subject heading records in MARC21 format;
  • the request for the creation, translation and modification of subject headings;
  • the RVM basic training held on site at the Bibliothèque de l’Université Laval (one free training session per Subscriber, irrespective of the number of employees, any additional training to be invoiced);
  • access to the Indexing Rules (ongoing development);
  • accession to the weekly, monthly and quarterly lists of new subject headings (with their semantic network);
  • accession to the list of free-floating subdivisions.

Licensed Users

RVMWeb is initially an occupational tool intended for the Subscriber’s documentation community, and more particularly the staff identified in the personal accounts.

However, the service « Search RVM » may be accessible to all of the documentation community staff of the Subscriber for consultation purposes, with no obligation to create a personal account if such consultation is carried in the Subscriber’s workplace.

On the other hand, the use of the following specific services is conditional upon a subscription and the creation of dedicated personal accounts for the exclusive use of staff members designated by the Subscriber:

  • the requests for the creation, translation and modification of subject headings;
  • the downloading of subject heading records in MARC21;
  • the RVM basic training;
  • access to the Indexing Rules;

Automated translation service (batch or itemized)

The Automated translation service of subject headings within bibliographic entries must be covered by a subscription unrelated to the services relating to the use of the contents of the RVM database. The use of this service is conditional upon the subscription and the creation of dedicated personal accounts for the exclusive use of the Subscriber’s designated staff members.

Permitted Uses

In consideration of the payment of subscription fees for the services relating to the use of the contents of the RVM database or the Automated translation service, the Subscriber and the Licensed Users may :

  • use the subject headings from RVMWeb in a library catalog or in any other system of a documentation community (openURL server, institutional repository, archives depository, management of research funds, etc.). However, a subscription grants the right to use the RVMWeb subject headings in only one documentation management or content management system. The use of subject headings from RVMWeb in several systems of the same Subscriber must be the subject of a specific agreement and additional fees;
  • search of subject headings in the RVM database;
  • download subject heading records in MARC21 format in the identified system;
  • request the creation, translation and modification of subject headings;
  • take part in a first free RVM basic training session held on site at the Bibliothèque de l’Université Laval;
  • have access to clickable subject heading lists (new subject headings and modified subject headings), to the list of free-floating subdivisions and to the list of the on-going requests for the translation/creation/modification of subject headings;
  • make use of RVM customer service via email, telephone, etc.

An Automated translation service Subscriber shall have access to the following services :

  • translate subject headings from English to French (LCSH to RVM), from French to English (RVM to LCSH) or bidirectionnally per item or in batch.

The Automated translation service is only applicable to subject headings of a bibliographic record. No other information of the bibliographic record is translated.

Forbidden use

A Subscriber and the Licensed Users may never :

  • use the products and services available through the RVMWeb site for commercial purposes;
  • copy, archive or store all or a substantial part of the content of the RVM database. In this regard, the use of automatic content downloading softwares, more commonly known as web robots, spiders, crawlers, wanderers or accelerators, is strictly forbidden. The complete downloading of the RVM database can only be done through a RVM FTP or CDROM format subscription;
  • regularly and systematically distribute to third parties RVMWeb data;
  • modify in any way whatsoever the content of RVMWeb.

Limitation of liability

As RVM is a product in continuous development, RVMWeb data are proposed as is by the Bibliothèque de l’Université Laval, without any other express or implied warranty not provided for in these conditions of use.

Termination of the RVMWeb Use Agreement

Université Laval shall have the right to terminate the RVMWeb Use Agreement, without prior notice should the invoice be unpaid within sixty (60) days of its shipment.

Also, the RVMWeb Use Agreement may be terminated in the case of non-compliance with one or more of its provisions by the Subscriber or one of its Licensed Users. In such a case, all of the personal accounts of the Subscriber and of its Licensed Users shall be automatically deacivated.

Information Security Regulation concerning the use of informatic assets of Université Laval

The Information Security Regulation concerning the use of informational assets (Règlement de sécurité de l’information sur l’utilisation des actifs informationnels) of Université Laval is applicable, making the required adaptations for the RVMWeb terms of use for the Subscribers and their Licensed Users. Intellectual property rights

Université Laval is the rightsholder of RVM and the RVMWeb site.

The controlled vocabularies Canadian Subject Headings (CSH), Répertoire d'autorité-matière encyclopédique et alphabétique unifié (Rameau), Library of Congress Subject Headings (LCSH), Medical Subject Headings (MeSH) and Getty Art & Architecture Thesaurus (AAT), Homosaurus (HOMOIT), OLAC Video Game Genre Terms (OLACVGGT), Gemeinsame Normdatei (GND), Faceted Application of Subject Terminology (FAST) are used in RVM solely for equivalence purposes with the RVM subject headings.

RVM linked data licence and attribution

The RVM in linked data is made available under a Creative Commons Attribution License (CC-BY). You are free to share or adapt the RVM in linked data in respect of the CC-BY license as long as the source of the content is acknowledged as follows:

In circumstances where providing the full attribution statement above is not technically feasible, the use of  RVM URIs (e.g. https://rvm.bibl.ulaval.ca/lod/autorite/201-0185779) is adequate as an attribution.

Amendment to the RVMWeb Use Agreement

The RVMWeb Use Agreement and its related services may be amended simply by a written notice forwarded by email to the address provided by the Subscriber when subscribing, by mail, or alternatively when posted on the RVMWeb home page, stating the nature of the amendment and its effective date. The Subscriber and its Licensed Users are deemed to have accepted these amendments if they continue to access RVMWeb after the notification or publication of this notice.

When the RVMWeb Use Agreement shall be amended, the Subscriber and its users must accept these amendments before being able to use the services covered by the subscription.

Should a Subscriber refuse the amendments to the RVMWeb Use Agreement, the Subscriber shall be refunded the proportional amount of the unused term of its annual subscription. The Subscriber must advise RVM of its refusal in writing.

Confidentiality of information and the protection of personal information

Université Laval is a public body within the meaning of An Act respecting access to documents held by public bodies and the protection of personal information (the « Ac  ») and is subject to its provisions.

By subscribing to RVMWeb, you authorize Université Laval to create a file containing information some of which may be personal information, within the meaning of the Act. Personal information is information concerning a natural person which allows the identification of the person. This information and personal information shall be handled by Université Laval as confidential. Only the administrative staff of Université Laval carrying out the development and support of the broadcast platform of RVMWeb and the subscription administrators of the RVMWeb subscriptions of Université Laval shall have access to this information and personal information.

If a Subscriber or one of its Licensed Users wishes to access or to correct information or personal information on file with Université Laval, he/she may contact a RVM representative at the following email address : rvm@bibl.ulaval.ca.

For the purposes of subscribing to RVMWeb, acquisition of the following information and personal information, if applicable, shall be one of the conditions of obtaining the subscription :

  1. name of the Subscriber;
  2. email address of the Subscriber;
  3. names of the Licensed Users of the Subscriber;
  4. user name.

Failure to provide the information described above prevents the subscription request to RVMWeb from being processed and suspends or ends the process.

Université Laval shall not use the personal information or any other information concerning the Subscribers and their Licensed Users other than for the purposes mentioned above and any such information shall not be forwarded or otherwise made accessible to third parties in any way unless authorized in writing by the Subscriber or one of its Users.

In the case of the cancellation or the abandonment of a RVMWeb subscription, the information and personal information concerning a Subscriber and its Licensed Users shall be handled according to the records retention schedule of Université Laval in force pursuant to the Archives Act (RSQ c. A-2.1).

Applicable law and jurisdiction

The RVMWeb Use Agreement shall be governed and interpreted in all respects pursuant to the laws in force in the Province of Québec.

Any litigation relating to the conditions of the use of RVMWeb shall be submitted to the Québec judicial district court of competent jurisdiction.

RVM and RVMWeb Trade Marks

Université Laval is the rightsholder of the RVM and RVMWeb Trade Marks and the use thereof is forbidden without the written consent of Université Laval.
